How will the money and assets be divided?
Sorting out the finances on separation, in particular deciding what happens to the matrimonial home, can be very stressful.
The system in England and Wales is discretionary, meaning that the judge will decide who gets what based on your individual circumstances. Because this can be quite unpredictable, many couples choose to decide on their own or by negotiation, mediation or collaborative law methods and ask the court to approve this.
A courts decision will always start with consideration of the welfare of any children involved. After that, the court will consider other factors that help it to determine a fair outcome. Once your solicitor knows about your individual circumstances, they will be able to give you specific advice.
If you are separating you should consider creating a new will to reflect your change in circumstances.
