Prenuptial Agreements

If you are about to get married or enter into a civil partnership, you may want to consider entering into an agreement to determine what will happen to your assets if you separate.

A prenuptial agreement can protect your personal assets and reduce the uncertainty of financial applications to the court. For example, you may wish to protect:

  • assets owned prior to the marriage,
  • gifts from your family,
  • inheritances.

Historically, prenuptial agreements have been unenforceable in England and Wales. However, the courts are becoming more flexible in their approach towards them and are increasingly taking them into account. In order for a prenuptial agreement to have the best chance of having 'binding effect', both parties must receive independent legal advice from their own solicitors. You should also arrange to enter into the agreement at least 3-6 weeks before the wedding date.
